1. Who offers MOVAC
MotorVacations.eu, also accessible via movac.eu, is provided by J. van den Elshout, based at Molenvaart 80, 1761 AL Anna Paulowna, the Netherlands. In these terms, “MOVAC”, “we” and “us” refer to this provider.

2. What these terms apply to
These terms describe the use of our public website, motorcycle travel information, map, and features for submitting locations. The map helps you find overnight accommodation, mountain passes, scenic roads, and other stops. The information available varies by location and source.
An announcement or feature labelled ‘in development’ is not an offer of a service that is already available. These terms alone do not conclude a paid subscription or booking and do not give you any right to a future app. Before you agree with us on a separate paid service or booking, we will explain the service, our role, the price, and the applicable terms.
3. Using and sharing the website
You may access the website, use information for your own trips, and share links to public pages. You may use offered export or sharing features for the purpose stated with them.
Do not disrupt the service, circumvent access restrictions, or impersonate someone else. Do not submit unlawful, misleading, or infringing content. Without permission, you may not systematically copy or republish protected content or a substantial part of our database. Statutory exceptions and rights under applicable open licences remain in force.
Report a potential security issue via info@motorvacations.eu. Do not view other people’s data, misuse the issue, or interrupt the service. This reporting channel does not grant permission to test secured systems.
4. Content and third-party rights
The rights to MOVAC’s original texts, images, design, software, and protected database components remain with us or the relevant rights holder. The fact that this material is publicly available does not automatically mean that you may copy it, sell it, or use it to train a commercial model. Request permission in advance to use protected MOVAC material outside the permitted use or a statutory exception.
For third-party material and open data, the respective licenses remain in effect. For example, the applicable OpenStreetMap license and attribution rules apply to OpenStreetMap data. These terms do not limit any rights that such licenses already grant you. Leave applicable source and rights notices intact.
5. Submitting locations, corrections and photos
Submit accurate information that you are permitted to share. Distinguish between what you know and what still needs to be checked. Upload only photos and texts for which you have the necessary rights. A photo on a hotel’s website is not automatically free to use. Avoid unnecessary personal data, identifiable persons without appropriate consent or another valid legal basis, and private information.
You retain the rights to your contribution. When you expressly agree to the submission terms, you grant MOVAC a non-exclusive, royalty-free permission to receive, store and review your submission and, after acceptance, to edit it for clarity and formatting, translate it and publish it on the website. That permission applies worldwide because the website is internationally accessible. Service providers may use the contribution only to the extent necessary to perform these activities for us.
This permission does not automatically apply to paid advertisements, standalone promotion, the sale of your photo, or publication in a future app. Where necessary, we will request additional permission for those purposes.
We may refuse or correct a contribution when it is inaccurate, irrelevant or unlawful, or infringes rights. Review does not mean that every detail has been independently verified.
You can ask us via info@motorvacations.eu to correct your contribution or terminate this permission. The permission ends when we receive your valid termination request, or on a later date that you specify. From that moment, we will stop new public use and remove existing public versions, including translations and adaptations under our control, without undue delay. Limited non-public retention may still be necessary because of the law, a dispute, or the completion of a backup cycle described in our privacy statement. We cannot directly remove copies held by independent third parties. Independently obtained factual information and applicable open-data rights do not lapse merely because a contribution is withdrawn. Your statutory privacy and copyright rights remain in force.
6. Travel information and third-party services
Check important information with the accommodation, road authority or another relevant source before relying on it. A map pin does not prove that a road is open, that camping is permitted or that a parking area is guarded. Our disclaimer describes the practical limitations and safety considerations.
If you follow a link and independently book with an external provider, that provider’s booking terms apply. Our own responsibility remains determined by law; a description in these terms does not change our actual role in a transaction. Paid placements and commercial relationships that we are required to disclose must be identifiable as such.
7. Privacy
Our privacy and cookie statement explains which personal data we process and what choices you have. Merely reading these terms or using the website does not constitute consent to analytics or marketing. If consent is required, we will request it separately.
8. Availability and our responsibility
We exercise reasonable care with respect to the website and the handling of corrections. Information may change, and maintenance or technical problems may interrupt accessibility. We do not promise uninterrupted access or the continued accuracy of every piece of third-party data.
Our liability is determined by applicable law. These terms do not exclude our responsibility for our own shortcomings where the law holds us responsible, and do not limit mandatory consumer rights. Nor do they exclude liability for fraud, intentional conduct, or death or injury caused by our negligence. You remain responsible for your riding behavior and compliance with traffic rules; this does not remove our own legal obligations.
9. Limitations and complaints
In the event of unlawful use, security risks or a material breach of these terms, we may take proportionate measures. Where reasonably possible, we will explain the reason and provide an opportunity to remedy the problem. Immediate action may be necessary to protect users, the service or legal rights. We will not disclose details where doing so would undermine security or conflict with the law.
You can report a problem or object to a restriction via info@motorvacations.eu. State the relevant page and describe what is happening. We will investigate the report and explain our response. Contacting us does not prevent you from exercising your legal rights or going to a competent authority or court.
10. Changes, languages and applicable law
We may amend these terms when the service or legislation changes. We will state the effective date and, where required, make important changes clear in advance. A new version does not remove rights retroactively and does not automatically amend an existing agreement. If your consent is required, we will ask for it.
Translations are intended to convey the same content. Your language choice does not determine your country of residence and does not affect local rights. Statutory rules of interpretation, including protection against unclear consumer terms, continue to apply.
Dutch law applies. If you are a consumer, this choice does not deprive you of the mandatory protection that would otherwise apply under the law of your habitual residence. The competent court is determined in accordance with the applicable jurisdiction rules. These terms do not require consumers to litigate exclusively in the Netherlands.
